Caution: Realtors and Prospective Buyers, HYLAND COURTS TOWNHOME ASSOCIATION is not the same as other Townhome associations. The boundaries for living here may appear similar, but they are not. They are different.
Yes, we are biased, but we sincerely believe our association is better!
Here is why:
First, dues are low and we are solvent. We have reserves to cover the life expectancy of almost all large items.
Some associations use management companies. Hyland Courts does not. We are managed by the people who live here. That means that you have to volunteer if you want to have an active voice in what happens. Fortunately, with 190 homes, we have many people who choose to volunteer. They simply contribute in their own areas of personal skill and interest.
When you purchase a home in Hyland Courts you agree to abide by the legal covenants established in the 1970's and occasionally modified by 75% of the homeowners. This Association predates the Minnesota statue covering Townhome associations. Therefore, some practices and legal implications can be different. For example, with rare exceptions, it is against the legal Covenents to rent out a Hyland Courts Townhome. You will want to read and understand both the legal Covenants on file with Hennepin county along with the current Rules & Regulations. Compliance processes are in place.
Townhome associations vary in terms of what is provided by the association and what is the homeowner's responsibility. Here, Common Ground starts right outside your front door. Common Ground includes the area under your driveway, patio and deck.
Here at Hyland Courts the Association takes care of the grounds, cul-de-sacs, parking areas, the pool, tennis courts and clubhouse. The Association also provides for snow removal. The Association pays for monthly sewer, water, and trash removal fees. Cable TV is available at sharply discounted rates. There is no charge for use of the tennis courts or swimming pool.
The basic driveway and home are the homeowner's responsibility. You are responsible to maintain the structure including the deck and driveway. You are responsible to maintain and replace the roof as needed. The Association helps by painting decks and resealing driveways on a periodic cycle.
Homeowner's often recommend contractors. Occasionally the Association will suggest contractors at less expensive group rates. Replacement and maintenance of the basic structure is up to the homeowner. It is your home. How the home appears to neighbors is a responsibility that the Association controls and must take very seriously.

IF & WHEN YOU DECIDE TO SELL YOUR HOME
Give a copy of this information to both your agent and your buyer. There is important legal information that should be shared with your real estate agent and prospective buyers. Buyers have ten days to review information before they close. You should make them aware of:
* Hyland's Legal Authority
* Association By-laws
* Rules & Regulations
* Monthly Fees
* Inspection Reports
* Pending Assessments
* Insurance Premiums
* Any outstanding problems.
Selling a home is no longer "let the buyer beware." You may lose a sale, have trouble closing,
even be sued or face arbitration if you fail to make proper full disclosures.We strongly suggest you make a copy of the Hyland Courts Directory available to serious buyers. You may make your own copies or request them from Hyland Courts. There may be a charge for extra copies but if you need them, let the Association know.
Hyland Courts differs from other Townhome associations. Living here really is special. There are certainly many more good points than poor ones. Your Association is managed by the people who live here. This is a small community. We care! Hyland Courts is not the same as a condominium.
Your association has special legal powers. Tested legal power exists to make assessments and enforce rules. The rules are in everyone's best interest. They are your rules. We all have a vested interest in keeping home values up. Sellers and new residents are expected to maintain their property. The Association insists that standards are maintained. Community participation is expected.
You know it is not as simple as "You take care of the inside and the Hyland Homeowners Association will take care of the outside." There are items like roofs, driveways, siding, sump pumps, outside lights, water controls, insurance, common grounds, the swimming pool, tennis courts, clubhouse to name just a few. Hyland Courts is a great value but, as we all know, there is no "free" lunch.
Obviously, the only way the Association can reach your agent and your buyer is through you. It really is in your best interest, as well as your legal obligation, to let your agent and buyer know. We will be glad to talk with anyone if they have questions.
